Uses, Patents, and Warranties
The Seller’s products are for laboratory use. They are NOT FOR FOOD, DRUG, COSMETIC, AGRICULTURAL or HOUSEHOLD USE. Since the Seller cannot control the Buyer’s application for its products, the Seller offers no warranty regarding their use or handling and will not be responsible for any loss or damage whatsoever. All international patents involving the Seller’s products are acknowledged. The Buyer is responsible for any patent infringements resulting from the use of the Seller’s products, singly or in combination with any product from any source. References herein are for information and suggestion only. Although all reasonable care has been taken in producing this publication, the Seller accepts no responsibility for error or omission. Other than the warranty of title as provided in the Uniform Commercial Code no warranty by the Buyer shall be implied or otherwise created, including but not limiting to warranty of fitness for a particular purpose. The Seller’s sole obligation and Buyer’s exclusive remedy with respect to products proved, to the Seller’s satisfaction, to be defective shall be to accept the return of said products, to the Seller, for a refund of the actual purchase price paid by the Buyer, or replacement with any alternative material if available. If the Seller is unable to supply any product, including items offered by way of custom synthesis, the Seller will contact the Buyer to advise of this situation but will be subject to no liability to provide the buyer with the said material. The Seller shall not be subject to any other obligations or liabilities with respect to goods or services rendered. Without limiting the generalities foregoing, the Seller specifically disclaims any liability for damages, punitive damages, lost profit or revenues, loss of use of product or equipment and any loss of property or disclaims all consequential, incidental or contingent damage whatsoever. The Buyer shall indemnify the Seller for and against any and all losses, damages and expenses, including legal fees and other costs of defending any action that the Seller may sustain or occur as a result of any claim of breach of contract or other theories of law by the Buyer, its officers, agents or employees, its successors or assignees, its customers or other persons, whether direct or indirect in connection with the use of any product or services supplied.
Buyer Agrees:
By buying any chemical from Advance Scientific And Chemical, Inc. that are not intended for any of the reasons listed above. Buyer also agrees by making any purchase, to hold Advance Scientific And Chemical, Inc. harmless for any injury, or damage, or liability, which may arise from the chemical purchase. Buyer must adopt all necessary safety precautions. Buyer should use proper ventilation, some type of non-absorbing and chemical resistant gloves and eye protective goggles when working with chemicals.
Method of Shipment
We generally ship our chemicals via the method specified by our customers. However, we reserve the right to change this method for certain hazardous chemicals which, when required by regulations, cannot be shipped safely by the preferred method. The dispatch by mail of products with dangerous properties is restricted.
Return Shipments:
We will not accept return shipment unless we have given prior permission and shipping instructions. We want to be fair and will do our best to cooperate, but the circumstances involving returns are often complicated and require individual attention and specific handling. Unidentified return shipments may be discarded.
